DrifterIQ Terms of Service
These terms are the agreement between you (the business that uses DrifterIQ, “you”) and Artemis Technology Solutions LLC, an Arizona limited liability company doing business as DrifterIQ (“DrifterIQ”, “we”). They cover the DrifterIQ app, the web app at app.drifteriq.com, the booking site we publish for you, and everything we do for you through them (the “service”).
Three other documents go with these terms:
- The DrifterIQ Payments Terms, which you agree to separately when you set up card payments. If the two disagree about payments, the Payments Terms win.
- The Client Terms, which your clients agree to when they book with you through DrifterIQ.
- The Privacy Policy, which explains how we handle information.
You agree to these terms when you tap Start my free trial or Subscribe at sign-up, when you agree to a new version in the app, or by using the service. The person who agrees confirms they are allowed to agree for the business. We record who agreed, which version and when.
1. Your account
- One owner. The person who creates the business account is its owner. The owner can add team logins, change the plan, export data, close the account and agree to new terms. If people inside a business disagree about the account, we follow the owner.
- Adults and real businesses only. You must be at least 18 and use DrifterIQ for a real business that provides services to clients.
- Keep your login private. You are responsible for everything done through your logins, including your team’s. Tell us at once at contact@drifteriq.com if a login is lost or misused, and keep your contact details current, because that is where our notices go.
- Support access. DrifterIQ’s own staff login may open your workspace to help you or to fix a problem. It never agrees to anything for you and never takes a payment for you.
2. What DrifterIQ is, and what it is not
- DrifterIQ is software. We provide scheduling, routing, a booking site, texts and emails to your clients, and the tools to take payments. We do not provide the haircut, the groom, the detail or any other service to your clients. You do.
- You run your business. You are an independent business, not our employee, agent, partner or franchisee. You decide your services, prices, hours, service area and policies. You hold the licenses, permits and insurance your trade and your state require, you collect and pay your own taxes, and you answer to your clients for your work.
- Your clients are your clients. The agreement for each appointment is between you and your client. We are not a party to it. Refunds, complaints and disputes about your services are between you and your client; the Client Terms say the same to them.
- Routes, times and prices are tools, not promises. Drive times, arrival estimates, route suggestions, dynamic prices and the figures in Reports come from maps, traffic data and the settings you chose. They help you decide; they are not a guarantee that a route, a time or a price will work out.
3. Your clients’ information
- It is yours. The client list, contact details, addresses, notes, visits and payments you keep in DrifterIQ belong to your business. We use them only to run the service for you, to keep it secure and to improve it, and in anonymous statistics that identify no one. We never sell them and never use them to market to your clients for anyone else.
- You are responsible for what you collect. You have your clients’ permission to keep their details, you tell them how you use them when the law requires it, and you honor a client who asks you to correct or delete their information. Keep health details (allergies, medications, a pet’s medical history) and card numbers out of notes, texts and files; card details go only into the card fields that Stripe provides.
- If information is exposed. If we learn that your clients’ information in DrifterIQ was accessed without permission, we tell you promptly with what we know, so you can meet your own duties to your clients, and we tell affected people and authorities where the law requires us to.
- When you leave. While your account is open you can export your clients and visits. When your account closes, your business information is erased 30 days later, except payment records, which we keep for 120 days after closing for refunds and card disputes. The Delete your account page has the full list of what is erased and what is kept. A client’s own DrifterIQ login, which can span several businesses, stays with the client; only your records about them go.
4. Texting through DrifterIQ
DrifterIQ sends texts to your clients in your name: confirmations, reminders, on-my-way messages, replies, and, on plans that include them, offers and client blasts. The carriers and the law hold the business whose name is on the text responsible for it, so:
- You have your clients’ permission for every text you ask us to send, and you can show it if a carrier or a regulator asks. For appointment texts, that is the mobile number the client gave for their booking. For offers and blasts, that is the client’s separate opt-in; a client who did not opt in gets no marketing text, even if you tick a box saying otherwise.
- The confirmation you tick before a blast (“I confirm these clients agreed to receive text messages from my business”) is your statement to us. We save it on each client’s record and rely on it.
- STOP means stop. When a client replies STOP, or tells us or you in any clear way that they want no more texts, the texts stop, and you may not turn them back on. The client can.
- Offers and blasts go out between 8 a.m. and 9 p.m. in the client’s local time, and never with content the carriers refuse: nothing unlawful, deceptive or adult, no cannabis or gambling, no loans, and no messages to numbers bought or rented from a list.
- Your number, our registration. The texting number we register for your business stays registered to DrifterIQ while you use the service. You may not move it elsewhere or use it to sign up for other services.
- Fines and complaints. If a carrier fines us or blocks our traffic because of texts you asked for, you cover the fine and the costs. We may pause your texting when complaints or opt-outs spike, and we tell you when we do.
Texts to your own phone (new bookings, payments, alerts) are sent only when you turn them on in the app. Reply STOP to any of them to turn them off.
5. Your content and ours
- What you upload is yours. Your logo, photos, videos, service names and descriptions, and the words on your booking site stay yours. You give us permission to show them on your booking site, in the texts and emails we send for you, in app previews of your site, and in the links your clients share, for as long as your account is open, and to keep copies in our backups for the periods the Privacy Policy gives.
- You have the rights to it. You may only upload what you own or are allowed to use. A photo of a client needs that client’s permission. Nothing unlawful, deceptive or hateful, and nothing that infringes someone else’s work.
- Copyright notices. If someone tells us that content on a booking site infringes their copyright, we may take it down and tell you, and we restore it when the claim is withdrawn or shown to be wrong. Notices go to our copyright agent, DrifterIQ Legal, at contact@drifteriq.com with the details the Digital Millennium Copyright Act asks for.
- DrifterIQ is ours. The app, its design, its routing and pricing engine, its words and its marks belong to DrifterIQ. You get a license to use them for your business while your account is open: not to copy, resell, scrape, reverse-engineer or build a competing product from them. Your clients get the same license for the booking site and their account.
- Ideas you share may be used by DrifterIQ freely and forever, without payment or credit, as the Insider Program Terms also say. Do not share an idea you consider your own confidential property.
6. Your plan and billing
- The plans. DrifterIQ is sold as a monthly subscription: Solo and Solo Plus. What each plan includes, its price and its text allowance are on the pricing page and in your checkout summary. Appointment texts are included in both plans. Text Credits for client blasts and offers, and packs of extra credits, come with Solo Plus; every allowance is a number, and nothing in DrifterIQ is unlimited.
- The free trial. A new business can start with a free trial of the length shown at checkout (14 days today). You save a card to start it. Your trial days begin on the day you book your first appointment, and no later than 30 days after you sign up, so you can load your clients first. We email you the day your days start and again 3 days before they end. When they end, the card is charged the plan’s price shown at checkout and your plan begins, unless you cancel in Settings › Billing first. One trial per business.
- Renewal. Your plan renews every month on the card on file until you cancel. The checkout and the welcome email show the price and the renewal date before you agree.
- Cancelling. Cancel any time in Settings › Billing, in one step. Your plan runs to the end of the month you paid for and then stops; we do not refund part of a month. Closing your account (section 10) cancels the plan the same way.
- If a payment fails. We try again and email you. You have 7 days to fix the card. After that your workspace is paused until it is paid: you can sign in and pay, your booking site shows your clients that online booking is paused, reminders for visits already booked keep going, and offers, blasts and new bookings stop. Your information stays. A workspace that stays paused for a long time may be closed under section 10.
- Changing plans. You can switch plans in Settings › Billing. The new price starts at your next bill; nothing is prorated. Plan features change at once.
- Price changes. We give you at least 30 days’ notice by email and in the app before a plan’s price goes up or an allowance goes down. The change applies from your next bill after the notice period. If you do not want it, cancel before then.
- Taxes. Prices exclude taxes. Where the law requires it (Arizona’s transaction privilege tax applies to software subscriptions), we add the tax to your bill and show it at checkout, and you pay it.
- Add-ons. Text Credit packs and any other add-on you buy are charged to your card on file when you buy them, at the price shown. Where the app lets you set a monthly cap for extra texts, charges stay within the cap you set.
- The founding price. If the pricing page offers a founding price when you subscribe, it is a discount on Solo Plus for the number of monthly bills stated there (today 50% off for your first 12 monthly bills, for subscriptions started by December 31, 2026). After that, the plan’s full price applies. One founding price per business; it may close to new sign-ups early, with notice; it combines with a referral credit and with nothing else.
- Referral credits. A credit you earn under the Referral Program Terms comes off your DrifterIQ bills. It is never paid in cash and can be reversed as those terms say.
- Receipts and billing records are in Settings › Billing. Our billing runs on Stripe; the card you give for your subscription is stored by Stripe, not by us.
7. Reviews, rewards and referrals
- Reviews. Your clients may rate a visit through the receipt we send. You may not offer a reward for a rating, rate your own business, change a booking to keep a client from rating it, or put words on your booking site or in your policies that punish a client for an honest review. We remove a rating only when it breaks the Client Terms, never because it is low.
- Rewards. Rewards for your clients are your program, run with our tool and under the rules the Client Terms give them (no cash value, one at a time, an expiry date, not combined with another discount). You may change or end your program; a reward a client already earned is honored until it expires, unless your account closes.
- Referrals. The Referral Program Terms govern the credits you and another business earn when you refer them.
8. Other companies’ terms that apply
- Stripe processes card payments and your subscription. Taking card payments needs the Payments Terms and Stripe’s Connected Account Agreement.
- Google Maps provides maps, addresses and directions. By using them in DrifterIQ you agree to Google’s Terms of Service and Privacy Policy, and to the Google Maps Additional Terms.
- Twilio carries our texts; Resend our emails; Google Cloud hosts the service; Capgo delivers app updates; Apple and Google distribute the apps under their store terms. Each receives only what it needs for its job, as the Privacy Policy explains.
9. What you may not do
- Share a login, or use DrifterIQ for a business other than the one on the account.
- Run a business that Stripe’s restricted businesses list excludes, or one the carriers refuse to carry texts for.
- Send texts or emails without permission, buy or rent contact lists, or use the service to harass anyone.
- Scrape, copy, probe or overload the service, upload malware, or get around a limit, a pause or a block.
- Use the service to break a law, or to do anything a court or a regulator has told you not to do.
10. Pausing, ending and closing
- We may pause or close your account when a payment is overdue (section 6), when you break these terms or the Payments Terms, when your use puts other customers, our vendors or DrifterIQ at legal or security risk, when Stripe or a carrier requires it, or when the law requires it. We tell you when we do and why, unless the law or a vendor does not let us. A serious or repeated breach may be closed without a pause first.
- You may close your account at any time from Settings, or by email if you cannot sign in. The Delete your account page says what happens: your plan stops with no refund for the rest of the month, upcoming visits are canceled and your clients are told unless you switch that off, your team’s logins and your booking site close, card payments stop while money already on its way to your bank still arrives, and you have 30 days to change your mind before your business information is erased.
- What survives. Amounts you owe, the Payments Terms for payments you took, your duties for texts you sent and content you published, sections 3, 5, 7, 11, 13 and 15, and anything else that by its nature should outlast the account.
- We may stop offering the service with at least 60 days’ notice, and we refund any prepaid part of a month you cannot use.
11. Our responsibility, and yours
We work to keep DrifterIQ available and accurate, and we are honest about what it does. But maps, carriers, banks, app stores and Stripe are outside our control, and your business is yours. To the extent the law allows:
- The service is provided as is. We do not promise it will be uninterrupted or error-free, that a drive time, an arrival estimate, a price, a route or a report will be right, that a text or an email will be delivered, or that a booking site will bring you clients.
- We are not liable for your services or for anything that happens at an appointment, for a client’s claim about your work, for a cancellation or no-show, or for how you set your policies.
- We are not liable for lost profits or other indirect losses, or for decisions made by Stripe, a bank, a card network, a carrier or an app store.
- Our total liability to you under these terms is limited to the subscription fees you paid us in the 12 months before the claim. The Payments Terms set their own limit for payments.
This limit never reduces a payout we owe you for your payments, and nothing in these terms limits liability that the law does not allow us to limit.
Your responsibility to us. If someone brings a claim against DrifterIQ because of your services, your policies, the texts or emails you asked us to send, the content you uploaded, your taxes, or your breach of these terms, you cover our reasonable costs of dealing with it, including attorney’s fees, as far as the law allows.
12. Changes, notices and agreeing electronically
Changes. We may update these terms. We tell you in the app or by email at least 30 days before a change that affects what you pay or what you owe, and we ask you to agree again when a change is significant. If you keep using the service after a change takes effect, that counts as agreeing to it. If you do not agree, you can cancel under section 6.
Notices. We send notices by email and in the app, and by text when you have text alerts on, using the contact details on your account. Notices to us go to contact@drifteriq.com.
Electronic agreement. Tapping a button, ticking a box or using the service is your signature, with the same effect as signing on paper, and we may keep these terms and your agreement as electronic records.
13. How we settle disagreements
- Arizona law governs these terms.
- Talk to us first. Write to contact@drifteriq.com and say what happened and what you want. We both try to settle it within 30 days.
- Then one arbitrator. If we cannot settle it, the disagreement is decided by one neutral arbitrator, not by a court or a jury, under the American Arbitration Association’s Commercial Arbitration Rules, in Maricopa County, Arizona, or by video. The decision is final. The Federal Arbitration Act applies to this agreement to arbitrate.
- One at a time. Each of us brings a claim only for ourselves, never as part of a class or group.
- Small matters stay simple. Either of us may use the small claims or justice court in Maricopa County for a claim within that court’s limits, and we may use those courts to recover an amount you owe.
- You can opt out of arbitration within 30 days of first agreeing to these terms, by emailing contact@drifteriq.com from your account’s email with the words “opt out of arbitration” and your business name. Then the courts below decide instead.
- One year. A claim under these terms must be started within one year of when it arose, where the law allows that limit.
- If part of this agreement to arbitrate cannot be enforced for a claim, that claim goes to the state or federal courts in Maricopa County, Arizona, and we both give up a jury trial as far as the law allows.
14. The apps and the stores
If you use the DrifterIQ app from Apple’s App Store or Google Play:
- The agreement for the app is between you and DrifterIQ, not Apple or Google. They are not responsible for the app or for supporting it, and they owe you no warranty for it; any claim about the app, including a product-liability or consumer-protection claim, is DrifterIQ’s to answer, as far as the law allows.
- If a third party claims the app infringes their rights, DrifterIQ, not the store, handles the claim.
- You confirm you are not in a country under a U.S. embargo and not on a U.S. list of prohibited or restricted parties.
- The store’s own terms apply to the download, and Apple and its subsidiaries may enforce this section as a third-party beneficiary of these terms.
- Your subscription is billed by DrifterIQ, not through the store, and is managed in Settings › Billing.
15. The rest
- Unfinished features. A feature marked new, beta or coming soon may change, pause or end, and information in a beta build may be reset. Early access is by our invitation and may close. The Insider Program Terms govern the insider roadmap.
- Transfers. You may not transfer these terms or your account to someone else without our written consent. We may transfer them with our business.
- If part of these terms cannot be enforced, the rest still applies. If we do not enforce a right once, we can still enforce it later.
- Events outside anyone’s control (a carrier outage, a natural disaster, a government order) excuse delays they cause, except paying what is owed.
- The whole agreement between us about the service is these terms, the Payments Terms, the Client Terms, the Referral Program Terms, the Privacy Policy and the Insider Program Terms. Headings are for reading only.
- Contact. Questions about these terms: contact@drifteriq.com. Artemis Technology Solutions LLC, Arizona.
